Stay Informed 2025 Nevada Legislature
The business of the 83rd session has been completed, with 518 bills signed out of 605 sent to Governor Lombardo’s office. While both the Northern and Southern section may include a session on legislative updates in the upcoming months, as well as at the APA State Conference at Minden in October, below are a few highlights to note:
- Governor Lombardo vetoed a record 87 bills this session. All bills that were vetoed, except one, were post-session and return to the 2027 session. One bill that was vetoed, SB 99, would have authorized the use of impact and linkage fees to build much needed housing within the Tahoe Basin.
- This session was highlighted by major bills on education, health care, election procedures, and housing. Following the wave a national legislation to address the housing affordability crisis, a number of new planning and housing bills were approved:
- With passage of AB 540, Nevada will direct $133 million toward housing projects, as part of the governor’s Nevada Housing Access and Attainability Act. More people will qualify for affordable housing after the definition was expanded to allow it to benefit people with up to 150 percent of area median household income (new “Tiers”), or incomes up to $100,000 in Clark County.
- AB 241 requires cities and counties to adopt an ordinance to allow applicants to build housing on property zoned for commercial use.
- AB 396 requires Washoe and Clark County, and the cities within those counties greater than 60,000 (Reno, Sparks, Las Vegas, Henderson, and North Las Vegas) to adopt an ADU ordinance. If not completed before 7.1.26, ADUs are authorized in any residentially zoned district without restriction.
- SB 28 authorizes local governments to establish tax increment areas outside of redevelopment agency areas for the purposes of constructing housing and transportation projects
- On the transportation front, AB 256 will establish a new statewide rail transit advisory committee, while AB 530 extends Fuel Revenue Indexing in Clark County, and AB 28 extends an RTCSNV ballot question for transit funding to 2028
- AB 96 requires local governments in Clark and Washoe Counties to add extreme heat to the conservation element of their respective master plans
- As the legislative session progressed, several amendments to the “Big Beautiful Bill” pertaining to the sale of Federal lands for housing were released, including an amendment from NV Representative Mark Amodei to include hundreds of thousands of acres in Nevada and Utah; after objections from the Nevada Congressional delegation and Montana representative Ryan Zinke, the amendment was dropped and the bill passed the House without the land sale language; however, on June 11, a Senate version was released including language specifying the sale of 2-3 million acres of BLM and Forest Service land for disposal in 11 states, including Nevada. Stay tuned for more details as this develops.
- A summary of all passed bills with amendments, changes or deletions to NRS 278 have been compiled below the signature block.
- A special session hasn’t been called, but has been rumored to occur at some point later this year as a result of tax revenue declines and other actions taking place at the Federal level.

- AB 131 - Enacts provisions of law relating to housing stability; ADUs at historic properties – No further consideration
- AB 241 - Revises provisions relating to development and zoning – Approved by Governor

- AB 396 - Revises provisions relating to housing; requires ADUs in residential zoning ordinance for local governments of Clark and Washoe Counties – Approved by Governor
- AB 443 - Revises provisions relating to property; eliminates local control over zoning, removes building and fire code protections – Failed deadline; No further action
- AB 530 - Revises provisions relating to the imposition Clark County of additional taxes on fuels for motor vehicles; FRI extension – Approved by Governor
- AB 540 - Enacts the Nevada Housing Access and Attainability Act; revises provisions on housing and tiers of housing, definition of attainable housing – Approved by Governor
- SB 28 - Revises provisions relating to economic development; expanded undertakings for housing and transportation in tax increment areas – Approved by Governor
- SB 48 - Revises provisions relating to planning and zoning; ensures consistency between master plan and zoning; new master plan elements – Approved by Governor
- SB 51 - Revises provisions relating to affordable housing – Failed deadline; No further action
- SB 61 - Revises provisions relating to annexation / detachment by certain cities within Clark County – Failed deadline; No further action
- SB 99 - Authorizes certain governing bodies of a county or city part of TRPA to impose impact and linkage fees on certain developers Approved; Vetoed by Governor; Returns to 2027 Session: VETO MESSAGE
- SB 147 - Revises provisions relating to regional planning of transportation; creates new Southern Nevada Regional Planning for Economic Resiliency Pilot Program – No further consideration
- SB 420 - Authorizes the creation of business improvement districts under certain circumstances – No further consideration
- SJR 4 - Urges the Federal Government to support certain land use planning principles when conducting projects in this State – Failed deadline; No further action
